This "nuts and bolts" program will focus on the requirements of the Federal Health Insurance Portability and Accountability Act of 1996 ("HIPAA") Privacy Rule and how it interacts with Virginia's privacy laws.
Civil Commitment: Legal Criteria and Guidance

This one day program will review the basics of the civil commitment process as it currently exists and will also focus on the DBHDS Commissioner's recently-issued guidance document on implementing outpatient civil commitment.
Informed Consent and Substitute Decision-Making: Law and Clinical Procedures

This full-day program will focus on the elements required for obtaining a consumer's informed consent to treatment and other matters. We will review in detail the legal alternatives to obtaining substitute consent when the consumer is incapable of making decisions on his or her own behalf.
Understanding and Implementing Virginia's Revised Health Care Decisions Act

Virginia's Health Care Decisions Act was amended by the 2009 General Assembly to increase opportunities for individuals to make health care decisions in advance directives and otherwise to clarify and streamline the requirements of the Act. This program will educate providers about the new law, with the guidance and insight of a faculty of experts with many years experience in applying the Health Care Decisions Act and who worked on the 2009 revisions. The sessions also will give providers an opportunity to give feedback about ways to improve the legislation going forward.
The program is presented by UVA Institute on Aging, UVA Institute of Law, Psychiatry and Public Policy, and the Virginia Hospital & Healthcare Association, jointly sponsored with the University of Virginia School of Medicine, in partnership with The Medical Society of Virginia, Virginia Health Care Association, Virginia Hospital Research and Education Foundation, Virginia Association of Nonprofit Homes for the Aging, Virginia Association for Home Care and Hospice, Virginia Department for the Aging, Virginia Department of Behavioral Health and Developmental Services, and Office of the Attorney General.
